Terms and Conditions of Tropicai-Shop
§ 1 scope, customer information
These general Terms and Conditions are valid for all business transactions between Tropicai-Shop and customers, who buy Tropicai products through our Internet Shop, Fax or Phone.
§ 2 conclusion of contract
The offers on our Internet Shop/Fax order form are non-binding offers for the customer to buy products.
After submitting the data and the clicking of the order button, the customer renders a binding offer to transact a contract of sale. The customer can also render a binding order via Fax or Phone.
Tropicai-Shop will send the customer an Email or Fax acceptance of the offer and the contract of sale is herewith concluded. The contract of sale through an order via Telephone is concluded at the time of acceptance.
Is a Telephone order not immediately accepted, the customer is not bound to the order.
§ 3 customer information: storage of customers order data
The order is saved by Tropicai-Shop along with particulars of the order (e.g. kind of product, price etc.). terms and conditions will be sent to the customer on request, but it is always online on our Shop website. As registered customer on our Internet Shop the customer can access the particulars of past order through the customer Log-in Area (your account)
§ 4 customer information: correction reference
The customer can cancel the order any time through the delete button. Tropicai-Shop is informing the customer on the way through the order process on additional correction possibilities. The order process can be terminated completely anytime through closing of the browser window.
§ 5 Return charges when exercising the right of revocation
In case of a valid revocation, the customer is obliged to bear the costs of the return shipment, if the merchandise delivered corresponds to the merchandise ordered, and if the price of the merchandise to be sent back does not exceed an amount of forty Euros or if, where the price is higher, the customer has at the date of the revocation not yet rendered consideration of given a part payment. In all other cases, the return shipment for the customer is free of charge.
§ 6 Reservation of proprietary rights
The goods shall remain property of Tropicai-Shop until full payment.
§ 7 Warranty
The statutory warranty provisions shall apply.
§ 8 Limitation of liability
Liability for slight breach of duty is excluded, provided that this does not pertain any contractual duties, damages pertaining to life, body or health or pertain to guarantees or claims from the product liability act. The same is valid for a breach of duty of the vicarious agents and legal representatives of Tropicai-Shop. Contractual duties are particularly the duty to deliver the goods free from material defects and defects of title and pass on the ownership to the customer.
Right of revocation
The customer may declare the revocation of the contractual statement in text form (e.g. letter, email) or by returning the merchandise within a period of 14 days. The revocation does not have to contain any grounds.
Tropicai-Shop will forward this revocation instruction to the customer again in text form. The revocation period commences the day following the receipt of merchandise and this revocation instruction in text form. The time-limit shall be deemed to be observed by the timely dispatch of the declaration of revocation or the return shipment.

The right of revocation does not apply on contracts for the supply of goods produced according to customer specifications or clearly tailored to personal needs or which, by reason of their quality, are not suitable for return or may spoil quickly or whose expiration date would be exceeded.
Consequences of revocation
In case of a valid revocation, all mutually received performances as well as emoluments taken (e.g. interest), if applicable, are to be restituted by either side. If the customer is unable or partially unable to restitute the merchandise to Tropicai-Shop or can only restitute it in a deteriorated condition, then the customer has to insofar compensate for its value where applicable. This does not apply if the deterioration is exclusively due to examine the merchandise - as for instance in a retail store - or putting the merchandise to its intended use. Things that can be shipped by parcel are to be returned on the risk of Tropicai-Shop. Things that cannot be shipped by parcel will be picked up. The customer is obliged to bear the costs of the return shipment, if the merchandise delivered corresponds to the merchandise ordered, and if the price of the merchandise to be sent back does not exceed an amount of forty Euros or if, where the price is higher, the customer has at the date of the revocation not yet rendered consideration or given a part payment. In all other cases, the return shipment for the customer is free of charge. All reimbursement obligations must be fulfilled within 30 days of the declaration of revocation.

§9 Terms of payment and rebates
Prices include German VAT as shown in our Internet shop. We reserve the right to correct in case of calculating or spelling mistakes.

Registered customers who order from us again will receive a rebate of 3% on every order (exclusive book orders). This rebate will be automatically deducted by our shop system if you are signed in.
